Terms of Service of GOM Tools for Shopify

GOM Tools for Shopify · GOM Network · Last updated: November 4, 2026

These terms govern the use of GOM Tools for Shopify (the “App”), an app by GOM Network (“we”) for Shopify stores. By installing the App, the store owner (the “Merchant”) accepts these terms and the data processing agreement in section 9. If you do not agree, do not install it.

1. The service

The App adds WhatsApp buttons and forms to the store, saves the contacts that arrive through the forms, measures visits and campaigns, shows reports and sends tracking events to the platforms the Merchant configures. The features and limits of each plan are described in the App’s Shopify App Store listing and on the App’s plans screen.

2. Account and access

The App is installed and used from the Shopify admin, with the store’s account. The Merchant is responsible for who has access to its admin and to the App.

3. Plans and billing

There is a free plan and paid plans. Shopify bills them on the store’s invoice, with the prices, trials and cycles Shopify shows when subscribing. Plans are changed or cancelled from the App or the Shopify admin. Downgrading does not delete data: what the new plan does not include is kept and stops being published. Refunds follow Shopify’s billing rules.

4. Acceptable use

The Merchant agrees not to use the App to send spam, collect data without a legal basis, impersonate others, infringe third-party rights or break the law or the policies of Shopify, WhatsApp, Google or Meta. We may suspend the service for a store that does.

5. The Merchant’s responsibilities to its customers

  • Tell its visitors and customers, in its own privacy policy, that it uses the App for forms, contacts, measurement and tracking events.
  • Have a legal basis to process their data and show the cookie consent notice its country requires. The App respects the consent choices the store records in Shopify.
  • Set up forms carefully and ask only for the data it needs.
  • Answer its customers’ requests about their data. The App helps with the requests that arrive through Shopify (see section 9).

6. The Merchant’s content and data

Settings, texts, forms, contacts and reports belong to the Merchant. The Merchant allows us to store and process them only to provide the App. We do not sell them or use them for advertising of our own.

7. Availability and support

We work to keep the App running and to make sure a failure on our side does not stop the store: buttons and forms stay visible even if our server does not respond. Even so, the App is provided “as is”, without a guarantee of uninterrupted availability. Support: info@gomnetwork.com.

8. Liability

To the extent the law allows, we are not liable for indirect damages, lost profits or lost sales, and our total liability is limited to what the Merchant paid for the App in the 12 months before the event.

9. Data processing agreement

This section applies to the personal data of the store’s visitors and customers that the App processes on the Merchant’s behalf.

  • Roles: the Merchant is the controller of that data and GOM Network is the processor that handles it on the Merchant’s behalf.
  • Instructions: we process the data only to provide the App, as the Merchant configures it and as our privacy policy describes.
  • Data: what visitors send through forms (for example name, email and phone) and, only with analytics consent, browsing data with a pseudonymous identifier, the campaign of origin and the ID and total of orders. The App does not read the store’s customer list and does not store IP addresses.
  • Confidentiality: only the members of our team who need it to operate or provide support access the data, under a duty of confidentiality.
  • Security: HTTPS on every connection; contacts, submissions and tokens encrypted at rest; every store’s data kept separate; a backup before every update.
  • Subprocessors: our hosting provider, where the servers and database run, and Shopify, which runs the store. Tracking platforms (Google, Meta) receive events only if the Merchant configures them, from the visitor’s browser and with their consent, and act under their own terms with the Merchant.
  • Data subject rights: we answer Shopify’s customers/data_request and customers/redact requests and help the Merchant with other requests.
  • Incidents: if a security incident affects that data, we will notify the Merchant without undue delay and no later than 72 hours after confirming it, with the information we have.
  • Retention and deletion: visits are kept according to the plan (30 days to 13 months) and submissions discarded as spam for 30 days. Contacts are kept until the Merchant deletes them. 48 hours after the App is uninstalled, Shopify notifies us and we delete all of the store’s data.
  • Transfers: data may be hosted outside the store’s country, with the security measures in this section.
  • Verification: the Merchant may ask us in writing for reasonable information to check that we comply with this agreement.

10. Termination

The Merchant can stop using the App at any time by uninstalling it. We may end the service for a store that breaches these terms. On termination, data is deleted as section 9 describes.

11. Changes

We may update these terms. We will publish the new version on this page with its date and, if the change is significant, announce it in the App.

12. Governing law and contact

These terms are governed by the laws of Colombia, including Law 1581 of 2012 on personal data protection. Contact: GOM Network, Bogotá, Colombia, info@gomnetwork.com.
